Other Remedies

Regulatory Services can exercise the following remedies if a facility fails to obtain the required statements and waiver, or if Regulatory Services denies a waiver but the facility does not discharge the resident:

• Seek an emergency suspension or closing order if Regulatory Services determines that there is a significant risk to the residents of the facility and an immediate threat to the health and safety of residents. [HSC §247.066(d-1)(2)]
• Seek other sanctions in lieu of an emergency suspension or closing order if Regulatory Services determines that there is a significant risk to a resident an immediate threat to the health and safety of residents. [HSC §247.066(d-1)(3)]
